Guidance to emergency support for temporary child support

Emergency support for temporary child support is a system to ensure safe child-rearing environment for a minor by offering child support temporarily to an obligee who has not received child support and is at risk of placing his/her minor in poor welfare or there is such a likelihood. After emergency support, the obligor will be subject to execute the right to indemnity.

Content of Support

Temporary emergency child support is 200,000 Won per child (100,000 Won for a child if there is a child-rearing cost based on「the Single-Parent Family Support Act」) and this will be provided for six months. If the crisis is not resolved, it can be extended up to three months once.

Subject of support

Those subjected to temporary and emergency child support will be screened to see if they satisfy the following conditions (1~5):

Procedure to support
  1. Those who rear a minor under 19 due to divorce or absence of marriage and have not received child support from obligors despite applications for implementation of child support to the Child Support Agency
  2. Those with a title of execution for child support (child support report or judgment)
  3. Those who are not receiving livelihood payment under 「the National Basic Living Security Act」 or livelihood support under 「the Emergency Aid and Support Act」.
  4. Income of a household to which an obligee belongs is below 50/100 of the middle income under Article 2-11 of 「the National Basic Living Security Act」 or an obligee is subject to support for single-parent families under Article 5 and Article 5-2 「the Single-Parent Family Support Act」.
  5. Anyone pertaining to any of the following:
    1. ① A crisis continues even after support from Article 9-1-1 of 「the Emergency Aid and Support Act」 and welfare of a child is at risk or has such as a likelihood (examples: diseases of children, failure to pay for schools and meals, two-month or longer overdue rents and utilities)
    2. ② Subject children or obligees have serious illnesses. They have been subjected to a surgery or hospitalization for one month or longer, which hinders daily life. Otherwise, other cases where care is needed for an illness or an injury.
    3. ③ Obligees are mother-side or father-side grandparents.
    4. ④ Obligees face economic difficulties due to job loss or closing of a business and the environment of a child’s growth is unstable
    5. ⑤ Other cases where the necessity for support is recognized by the Temporary Child Support Payment Screening Committee.

Documents

The following documents shall be prepared and received in person, via post or online means.

  • One copy of application form for emergency temporary child support

  • One copy of the result notification for emergency welfare support(the supporting period shall be reflected.)

  • One copy of documentary evidence where a risk is at stake or there is such likelihood.*

  • One copy of documentary evidence proving single-parent families

  • One copy of health insurance payment statement **This may be omitted if there is a certificate of a single-parent family.

  • One copy of a title of execution
    (child-rearing report or judgment)

  • One copy of the bankbook with the account number shown

  • One copy of resident registration

* Overdue utilities including water and electricity
